Insolvency
Our services
The department has expanded rapidly over the last four years in terms of the quality and depth of its client base and the number of fee earners engaged in the work. We act for a large number of insolvency practitioners across the Midlands as well as London. We also act for HM Revenue and Customs in relation to its more complex cases involving the recovery of unpaid taxes and excise duty.
The department has an established reputation for contentious insolvency litigation (particularly wrongful / fraudulent trading/misfeasance /preferences and transitions at an undervalue). We were founder members of the Forensic Recovery Service (FIRS) and took part in the pilot scheme which led to the founding of the National Civil Recovery Rota.
We are also a member of the Insolvency Creditor’s Association. We have extensive knowledge
of the adverse costs insurance market.
In terms of non-contentious insolvency, we handle IVAs, CVAs and applications for administration
orders. The department has many years’ experience acting for insolvency practitioners; recovering and selling assets and selling businesses as going concerns. We are also highly experienced in acting for purchasers of assets and businesses from insolvency practitioners, where we can use our experience of acting for insolvency practitioners to advise our clients on what is, and is not reasonable to expect from a purchase from an insolvency practitioner.
We have links with an extensive network of firms throughout Europe, North America and Asia, who are able to assist on insolvency matters in those jurisdictions and cross-border issues.
The department’s objective is to offer commercial and practical solutions to our clients. City quality at regional prices.
